1. General

1.1 The ‘Hirer’ means the person named on the invoice.


1.2 The company is 'The Hip Hooray Company " also known as "Hip Hooray Parties".


1.3 Provisional bookings will be held for 3 days before deposit is due. If a deposit is not paid within 3 days of submitting a booking request, your date will not be secured and will be made available again to those on our waiting list.


1.4  Completion of a booking form and payment of a deposit on acceptance by The Hip Hooray Company constitutes a binding contract.


1.5 We regret we are unable to accept bookings from anyone under 18 years of age.


1.6 All rubbish/recycling must be removed at the end of your event prior to collection. The Hip Hooray Company reserve the right to levy a charge, which will be deducted from your security deposit, for the removal of any rubbish or waste left in the tent.


1.7 Hire price includes delivery within a 10 mile radius of our Caterham base.


1.8 Out of area bookings can be arranged subject to availability and an additional cost of 75p per mile (4 ways).


1.9 The Hip Hooray Company accept no responsibility or liability for damage or theft to any property duration of the hire period.


1.10 The Hip Hooray Company accept no responsibility or liability for damage or injury to any member of your party that may occur whilst you are in occupation of The Hip Hooray Company equipment.


1.11  The Hirer is responsible for ensuring adequate space is available for the equipment to be set up and arranged. The space required for one 5 metre bell tent is 7 metre x 7 metre flat area of real grass (can not be pitched on artificial grass), free from overhanging trees, pathways, garden furniture and play equipment). The Hip Hooray Company will not refund in full or in part the monies paid in the event that adequate space is not available to set up the equipment which the Hirer has confirmed on the Booking Form.


1.12 The Hip Hooray Company equipment must not be used outdoors without the expressed prior agreement from The Hip Hooray Company. This must be approved by The Hip Hooray Company staff at the time of booking and requests will not be considered after deposit is paid.


1.13 Smoking and pets are not permitted in the proximity of The Hip Hooray equipment. However, disabled assistance dogs (e.g. guide dogs, hearing dogs etc) are welcome by prior arrangement.


2. The Hip Hooray Company Undertakings


2.1 The Hip Hooray Company will deliver, erect and furnish your bell tent/teepees/picnic to the agreed location on the first day of the commencement of your booking.


2.2 The Hip Hooray Company will dismantle and remove all equipment from your event location on the day of termination of your hire period.


2.3 While The Hip Hooray Company will do everything possible to ensure set up is at the agreed time and date, no responsibility or liability can be accepted for delays due to road accidents or severe traffic problems.


2.4 The Hip Hooray Company shall use all reasonable endeavours to provide the services in accordance with the contract and shall perform the services with reasonable skill, care and diligence.


2.5 Nothing in these terms shall limit or exclude the liability of The Hip Hooray Company, which may not be limited or excluded by law, including without limitation liability for death or personal injury caused by  The Hip Hooray Company or negligence.


2.6 Subject to the above The Hip Hooray Company shall have no liability (whether arising under contract, tort, or for breach of statutory duty or otherwise) to the extent that such liability would not have arisen but for the Hirer’s breach of the contract.


2.7 Subject to the above clauses The Hip Hooray Company liability for all claims in relation to the contract (whether arising under contract, tort, or for breach of statutory duty or otherwise) shall not exceed the price paid by the Hirer.


2.8 It is the responsibility of the Hirer to inform guests accordingly of the above terms and conditions.


2.9 The Hip Hooray Company have suitable public liability insurance and take the utmost care to ensure the safety of all party guests at all times.


2.10 We use quality products and follow strict hygiene routines.


2.11 All persons using The Hip Hooray Company equipment do so at their own risk and it is the party hirer who is responsible / liable for any damage or injury occurring from or as a result of inappropriate use or misuse or reckless use.


2.12 This information is given for the safety of all people attending a party hosted by The Hip Hooray Company and it is the sole responsibility of the Hirer to ensure that they are understood and adhered to by all party guests invited.


3. Payment


3.1 A £75 non-refundable deposit is payable on booking.


3.2 The balance of hire payment is due 7 days before your event.


3.3 A £200 refundable security deposit is required with the balance of payment for bell tent bookings or £150 for all other bookings including picnic parties. The security deposit is refundable once the equipment has been collected undamaged and fully tested (normally within 48 hours). In the unlikely event that any items are damaged replacement costs will be deducted.


3.4 The security deposit will be refunded by bank transfer within 7 working days of the end of your hire period.


3.5 Payment can be made by bank transfer to the following account:

4. Cancellation


4.1 Your hire booking will be treated as cancelled if the balance of the hire payment is not received by us by the date specified on the booking form (7 days before the commencement of your hire) or unless alternate payment terms have been agreed.


4.2 If you wish to cancel your booking once you have paid your initial deposit please notify us immediately. In these circumstances your initial deposit is non returnable and any contract is rendered void.


4.3 If you cancel once you have paid the full cost of your tent hire, we are unable to return any monies to you, unless we are able to rebook the bell tent for the period in question. In these circumstances we may offer the tent at a reduced rental to encourage a late booking and any money we recover we will refund to you.


4.4 In the event of extreme or adverse weather conditions making it impossible to erect the bell tent, the Hip Hooray Company cannot accept any responsibility or liability for losses or other costs incurred as a result. In this situation we will work with you to offer you an alternative site/date, where possible.


4.5 The Hip Hooray Company reserve the right to cancel your hire booking at any time. In the unlikely event of this happening, a full refund will be made, however The Hip Hooray Company will not accept responsibility or liability for losses or any other costs incurred as a result.


4.6 Should your chosen location cancel or terminate your booking for any reason whatsoever, no refund will be given by The Hip Hooray Company. In this case, please contact us as a matter of urgency and we will do our utmost to help you find an alternative site.


5. Health and Safety


5.1 The Hip Hooray Company operate a STRICT NO SMOKING policy inside the bell tent.


5.2 Candles with flames are not permitted in the proximity of The Hip Hooray Company equipment. Battery operated candles/lights will be provided.


5.3 For your protection and safety, cooking is prohibited inside the bell tent.


5.4 Fire pits and BBQ’s should be sited a safe distance from the bell tent and should not be left unattended.


5.5 The Hirer is responsible for providing The Hip Hooray Company staff with all relevant medical/dietary information for all the guests attending the party. We take no responsibility for allergies (including skin, food, materials etc.) where we are not advised in advance of the condition. We are likewise not responsible at any point, for the welfare of the guests at the parties, which remains the full responsibility of the hirer. The hirer must ensure the safe use of our hire equipment, it should not be climbed on or moved after it has been set up. Bunting and lighting can represent a risk of strangulation and the children must be supervised at all times when the decoration is displayed.


5.6 It is the Hirers responsibility to ensure that the children are supervised at all times. The Hip Hooray Company will charge the hirer for the costs of any damage to any property caused by your breach of this clause. 


5.7 It is the Hirers responsibilities to ensure the children comply with all reasonable instructions from The Hip Hooray Company to ensure the safety of the attendees and other persons present. The Hip Hooray Company may suspend the event if you are in breach of this clause.


5.8 The Hirer is responsible for the care and safety of all the children and should ensure that all parent/guardians are aware that The Hip Hooray Company are not responsible for the care and safety of the children.


5.9 The Hirer will be required to take responsibility for all children that have been left by their parent/guardian.


5.10 We would recommend that the Hirer of the party take contact telephone numbers of the children attending if their parent/guardian is not staying at the same time as clarifying any medical/allergic conditions at least 7 days in advance of the event.


6. Legal Details


6.1 Force Majeure (unforeseeable circumstances preventing someone from fulfilling a contract)

The Hip Hooray Company cannot accept any responsibility or liability for losses or other costs incurred as a result of: acts of God including fire, flood, storm or natural disasters, war, sabotage or acts of terrorism, government sanctions, labour disputes including strikes, lockouts, boycotts or other Industrial action, failure in the transportation of equipment or in the provision of services.


6.2 Governing Law & Jurisdiction

This agreement and disputed or claims arising out of or in connection with it or its subject matter or formation (including non contractual disputes or claims) are governed by and construed in accordance with the laws of England.


6.3 The parties irrevocably agree that the Courts of England have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this agreement or its subject matter or formation (including non contractual disputes or claims).
